Success Stories

Electronics Importer: Classification Dispute Resolution

Challenge

A Bangkok-based electronics importer received classification reassessment notices from the Customs Department covering two years of declarations. The reassessment would have resulted in substantial additional duty payments and penalties. The importer had limited documentation supporting their original classification positions.

Solution

We conducted detailed product analysis examining component materials and manufacturing processes. Our team prepared a comprehensive response to the Customs Department including technical specifications, HS code justification based on section notes, and supporting references from World Customs Organization guidance. We represented the client in discussions with customs officers.

Results

The Customs Department accepted our classification position for the majority of products after reviewing the documentation. The client paid minimal additional duties covering a small subset of items where classification adjustment was warranted. No penalties were assessed. The engagement took four months from initial notice to final resolution.

"The organized response and technical analysis Portivus provided gave us a defensible position during the audit. Their representation with customs officers was professional and effective."

Manufacturing Company: Free Zone Implementation

Challenge

A Chonburi manufacturer needed to establish a Free Zone facility to support duty suspension on imported components used in export manufacturing. The company lacked experience with Free Zone licensing requirements and operational compliance obligations. Initial attempts to navigate the application process independently had stalled.

Solution

We advised on facility requirements, prepared the licensing application documentation, and explained stock accounting system standards the Customs Department would require. Our team developed operational procedures for zone transfers and designed the annual reporting framework. We accompanied the client during customs inspection of the proposed facility.

Results

The Free Zone license was granted within three months of our engagement. The facility became operational immediately following approval. The client now benefits from duty suspension on imported materials valued at over ฿200 million annually. We continue to provide annual reporting assistance and operational compliance guidance.

"Portivus understood what the Customs Department needed to see in the application and helped us prepare everything correctly the first time. The duty suspension benefits have significantly improved our cash flow."

— Operations Director, Auto Parts Manufacturer

Trading Company: FTA Optimization

Challenge

A Bangkok trading company imported products from multiple ASEAN countries and China but had not fully explored FTA preferential tariff opportunities. They were uncertain which agreements offered the best duty treatment for their specific products and lacked clarity on origin documentation requirements for preference claims.

Solution

We analyzed their product portfolio against ATIGA, ACFTA, and bilateral FTA provisions. For each major product category, we determined which agreement offered the lowest duty rate and assessed whether origin criteria could be met. We provided guidance on obtaining and maintaining the required origin certificates and declarations.

Results

The client identified duty savings of approximately ฿2.4 million annually by utilizing appropriate FTA preferences. They implemented systematic origin documentation procedures based on our guidance. The advisory fee represented less than 5% of the first year's duty savings, providing clear return on investment.

"We had been paying full duty rates on imports that qualified for FTA preferences. The analysis Portivus provided identified specific opportunities and showed us how to claim them properly."
